In Thailand, foreigners can buy freehold condominiums under certain conditions. Here are the key points to keep in mind:
Foreign Ownership Quota: Foreigners can own up to 49% of the total area of all units in a condominium project. The remaining 51% must be owned by Thai nationals or Thai entities.
Funds Transfer: The money used to purchase the condominium must be transferred from abroad and in foreign currency. The funds must be recorded as a foreign investment by the receiving bank in Thailand, which will issue a Foreign Exchange Transaction Form (FET Form) for amounts over USD 50,000. This document is necessary for the registration of the condominium ownership at the Land Department.
Registration Process: The buyer must present the FET Form, passport, and purchase agreement at the Land Office to register the ownership of the condominium unit. It’s advisable to use the services of a legal professional to assist with this process to ensure all requirements are met.
